Terms & Conditions of Happier Mind Workshops Retreats

This page provides you with information about us and the legal terms and conditions (“Terms”) on which we sell any of the retreats (“Retreats”) listed on our website (“our site”) to you.

These Terms will apply to any contract between us for the sale of Retreats or the provision of Services to you (“Contract”). Please read these Terms carefully and make sure that you understand them, before ordering anything from our site. Please note that before placing an order you will be asked to agree to these Terms. If you refuse to accept these Terms, you will not be able to order any Products and/or Services from our site.

You should print a copy of these Terms or save them to your computer for future reference.

We amend these Terms from time to time. Every time you wish to make an order, please check these Terms to ensure you understand the terms of your order which are applicable at that time. These Terms were most recently updated on 12 October 2019.

These Terms, and any Contract between us, written only in the English language. Please ensure that you translate to another language if preferred and to ensure that you are fully aware and accepting of the terms.

1. INFORMATION ABOUT US

We operate the website www.HappierMindWorkshops.com. We are Happier Mind Workshops, a collaboration between two wellbeing practitioners, operating in multiple countries. Our registered business addresses are 53 Barrachnie Crescent, Glasgow, Scotland, UK and Gabi Workshop, Isla Margarita 10, 38627 Tenerife

2. YOUR STATUS

In order to place an order on our site for Retreats or other Services, there may be some restrictions dependent on the product where you must be at least 16 years of age. Any minimum age restrictions or any other restrictions will be clearly noted.

Our Retreats and Services aim to assist with increased physical and mental wellbeing, however if you have any ongoing issues which are being treated by medical professionals , we do not declare that this is any substitute for ongoing treatment. With regard to physical and mental capacity, the responsibility of deciding whether to participate in our Retreats or any other Services lies with you and you agree when you purchase a Retreat or other Service that your physical and mental health are of a standard for participation.

3. OUR RETREATS

The images of the Products (art resources ets, yoga mats) on our site are for illustrative purposes only, although we have made every effort to display the areas we work within and the resources with complete accuracy, the colour of our images may differ in different seasons.

4. HOW WE USE YOUR PERSONAL INFORMATION

We hold your personal information confidentially and only use your personal information to contact you and we do not disclose to any other third parties.

We will not take or use any pictures of you or any feedback you provide unless you wish this to be shared.

5. PAYMENT

You can pay for Retreats or any other Services using most card types. You will be directed to Paypal directly from the payments page within our webpage. Please contact us if you require to pay using another source.

By placing an order for any Retreat or other Service you accept that they are reserved for you until paid in full and then your reserved place becomes a secured place. Full payment must be received one week prior to the Retreat/Service start date. No refund of deposit will be given unless in the very unlikely event of the hosts cancelling the programme, then full refunds of payments received will be made.


6. EVENTS OUTSIDE OUR CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. An Event Outside Our Control is defined as

civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, failure of public or private telecommunications networks, impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport, or malicious damage or access (including, but not limited to distributed denial of service attacks, hacking or any other unauthorised access) or failure of any utility service (including any hosting services provided to the Supplier by a third party from time to time).

If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract:

We will contact you as soon as reasonably possible to notify you; and

our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of Retreats or Services to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.

You may cancel a Contract affected by an Event Outside Our Control which has continued for more than 30 days.

7. OTHER IMPORTANT TERMS

We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights or our obligations under these Terms.

19.2 You may only transfer your rights or your obligations under these Terms to another person if we agree in writing.

19.3 This contract is between you and us. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise.

19.4 Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

19.5 If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
